Abstract
Sudar brodova je materijalni sraz dvaju ili više brodova, koji za posljedicu ima nastanak štete barem na jednom brodu, stvarima ili osobama na brodu. Osnovni elementi pojma sudar brodova su materijalni sraz brodova i nastanak štete. Materijalni sraz podrazumijeva fizički dodir jednog broda s drugim. Također, objekti u sudaru moraju imati pravni status pomorskog broda. Sudari brodova dijele se prema krivnji pa se razlikuju skrivljeni i neskrivljeni sudari. Brodar odgovara za štete iz sudara temeljem dokazane krivnje koja se izražava u postotcima. U slučaju neskrivljenog sudara svaki brodar sam snosi svoju štetu. Kod skrivljenog sudara, osim za materijalne štete brodar odgovara i za izmaklu dobit, dok je visina odgovornosti brodara ograničena.
Abstract (english)
A ship collision is a physical collision between two or more ships, resulting in damage to at least one of the ships, things on board or people on board. The basic elements of the term ship collision are the material collision of the ships and the occurrence of damage. Material collision means the physical contact of the ships. Objects in a collision must have the legal status of a vessel. Ship collisions are divided according to fault, so there is a difference between wrongful conduct and collision without fault. The shipowner is liable for collision damages based on proven fault, which is expressed in percentages. In the event of a collision without fault, each shipowner is liable for his own damages. In the event of a wrongful conduct collision, in addition to material damages, the shipowner is also liable for lost profits, while the amount of liability of the shipowner is limited.
